1. Services Provided
Absolute Documents (“we,” “our,” or “us”) offers paralegal services specializing in the preparation of Canadian pardon applications and U.S. entry waiver applications (“Services”). Our role is to assist clients in preparing necessary documentation in accordance with applicable laws and regulations. We are not lawyers and do not provide legal advice.
2. Acceptance of Terms
By using our Services, you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions. If you do not agree to these terms, you should not use our services. These terms comply with Alberta’s Consumer Protection Act and applicable federal regulations.
3. Payment and Refund Policy
3.1 Payment Terms
All fees for Services must be paid in accordance with our fee schedule provided at the time of engagement. Payment constitutes acceptance of these terms.
3.2 Limited Refund Policy
All payments made to Absolute Documents are final and non-refundable, except in the limited circumstance where we are unable to provide the agreed-upon services due to a mistake or error on our part.
No refunds will be provided for:
Client dissatisfaction with application outcomes or government decisions
Changes in your personal circumstances after service commencement
Your failure to provide required information or documentation
Government fee increases or policy changes
Changes in laws or regulations affecting your application
Any disbursements paid on your behalf to third parties (including government fees, court costs, or other third-party charges)
3.3 Refund Process
Any refund requests must be made in writing within 30 days of the issue arising. We will respond within 30 days and, if approved, process refunds within 60 days.
4. Compliance and Legal Limitations
4.1 Regulatory Compliance
Absolute Documents performs Services in compliance with:
Alberta’s Consumer Protection Act
Federal privacy legislation (PIPEDA)
Alberta’s Personal Information Protection Act (PIPA)
Applicable paralegal practice standards
4.2 No Guarantee of Approval
Important Notice: We do not guarantee approval or success of any application, as such decisions rest solely with the relevant government authorities. Government agencies have sole discretion over application approvals, and factors beyond our control may affect outcomes.
4.3 Government Fee Changes
Government application fees and requirements may change without notice. Any additional costs resulting from such changes will be your responsibility.
5. Client Responsibilities
5.1 Information Accuracy
You are responsible for providing accurate, complete, and truthful information and documentation necessary for the preparation of your applications. You must:
Provide all requested documents promptly
Disclose all relevant information, including potentially negative information
Notify us immediately of any changes that may affect your application
Review all documents before signing
5.2 Ongoing Compliance
You must not commit any crimes or engage in illegal activities while using our Services. Any such conduct may result in immediate termination of Services without refund, as it may compromise the integrity of your application.
6. Service Standards and Error Correction
6.1 Quality Assurance
We guarantee that all paperwork prepared and filed on your behalf will be free from errors caused by our negligence or oversight, provided you have supplied accurate and complete information.
6.2 Limitation of Guarantee
Our guarantee does not extend to:
Inaccuracies arising from incorrect or incomplete information you provide
Errors in documents obtained from courts, government agencies, or other third parties
Changes in laws or regulations affecting your application
Government processing delays or administrative errors
6.3 Error Correction
Should errors attributable to us require correction, we will assist in rectifying them at no additional charge. However, additional government fees or third-party costs may apply and will be your responsibility.
7. Disbursements and Additional Costs
7.1 Third-Party Costs
You are responsible for all legitimate third-party disbursements, including but not limited to:
Court fees and filing costs
Government application fees
Background check fees
Document certification costs
Courier and shipping fees
7.2 Transparency
Absolute Documents does not profit from disbursements. We will provide detailed receipts and proof of all costs upon request. All disbursements will be disclosed in advance where reasonably possible.
8. Privacy and Confidentiality
8.1 Privacy Policy
By using our Services, you acknowledge and agree to be bound by our Privacy Policy, which governs the collection, use, and protection of personal information and complies with Alberta’s PIPA. Our Privacy Policy is available at [www.absolutedocuments.ca/privacy].
8.2 Confidentiality
We maintain strict confidentiality regarding all client information and documents, except where:
Disclosure is required by law
Disclosure is necessary to provide the Services (e.g., submitting applications to government agencies)
You provide written authorization for disclosure
9. Communication and Service Delivery
9.1 Communication Methods
We will communicate with you via the contact methods you provide. You are responsible for:
Maintaining current contact information
Monitoring your communications regularly
Responding to our requests within reasonable timeframes
9.2 Service Timeline
While we strive to complete services efficiently, timelines may vary based on:
Government processing times
Complexity of your case
Your responsiveness in providing information
Court and agency availability
We will provide reasonable estimates but cannot guarantee specific completion dates due to factors beyond our control.
10. Limitation of Liability
10.1 Scope of Limitation
IMPORTANT: This section limits our legal liability. Please read it carefully.
To the fullest extent permitted by law, our total liability for all claims arising from our Services shall not exceed the total fees you have paid to us for the specific services giving rise to the claim.
10.2 Excluded Damages
We shall not be liable for any indirect, incidental, consequential, or punitive damages, including but not limited to:
Lost opportunities or employment
Travel costs or time
Emotional distress
Government application fees (which are non-refundable by the government)
10.3 Exceptions
Nothing in this section limits our liability for:
Fraud or intentional misconduct
Gross negligence
Matters that cannot be limited by law under Alberta’s Consumer Protection Act
11. Force Majeure
We shall not be liable for any failure or delay in performing our Services due to circumstances beyond our reasonable control, including but not limited to:
Government office closures or delays
Natural disasters or public health emergencies
Changes in laws or government policies
Technical failures of government systems
12. Termination
12.1 Your Right to Cancel
You may terminate our Services at any time by providing written notice. Upon termination:
You remain responsible for all work completed to the date of termination
Refunds will be considered in accordance with Section 3
We will return your original documents upon request
12.2 Our Right to Terminate
We may terminate our Services if:
You fail to pay required fees
You fail to provide necessary information or documentation
You engage in conduct that compromises the integrity of your application
Continuing service would violate legal or ethical requirements
13. Dispute Resolution
13.1 Initial Resolution
We encourage you to contact us directly to resolve any concerns about our Services. Many issues can be resolved through direct communication.
13.2 Mediation
If direct resolution is unsuccessful, you agree to participate in mediation before pursuing other legal remedies.
13.3 Consumer Protection Rights
Nothing in these terms limits your rights under Alberta’s Consumer Protection Act or other applicable consumer protection legislation.
14. Governing Law and Jurisdiction
14.1 Applicable Law
These Terms and Conditions shall be governed by and construed in accordance with the laws of Alberta and Canada.
14.2 Jurisdiction
The courts of Alberta shall have exclusive jurisdiction over any disputes arising from these terms, subject to your consumer protection rights.
15. Amendments and Updates
15.1 Right to Amend
We reserve the right to modify or update these Terms and Conditions. Material changes will be:
Posted prominently on our website at www.absolutedocuments.ca
Communicated to existing clients via email where feasible
Effective 30 days after posting unless you are notified otherwise
15.2 Continued Use
Continued use of our Services after changes constitute acceptance of the revised terms. If you do not agree to changes, you may terminate our Services in accordance with Section 13.
16. Severability
If any provision of these Terms and Conditions is deemed invalid or unenforceable by a court of competent jurisdiction, the remaining provisions shall remain in full force and effect.
17. Entire Agreement
These Terms and Conditions, together with our Privacy Policy and any service-specific agreements, constitute the entire agreement between you and Absolute Documents regarding our Services.
