  • How long will it take to get my waiver?

The U.S. Customs and Border Protection (CBP) Admissibility Review Office (ARO) is currently experiencing significant delays in processing waiver applications due to high volume. Waivers are now taking more than a year to process. The ARO office has stated that wait times can take up to 6 months or longer.

  • Do I qualify for a waiver?

Generally, most cases have a good chance of being approved for a waiver. However, there are certain situations that result in guaranteed rejection. These are typically extreme cases, such as espionage or serious human rights violations (e.g., genocide, Nazi-related convictions). In these instances, the U.S. government would have made it explicitly clear that you will NEVER be permitted to enter the United States again.

  • I am indigenous, do I still need a waiver?

If you are a Status Indian recognized under the Indian Act, you normally do not require a waiver under the Jay Treaty of 1794. However, in recent years, we have seen an increasing number of Status Indians being turned away at the border. For time-sensitive matters in the U.S., we still recommend that Status Indians with a criminal history obtain a waiver to avoid potential issues.

  • How much does a waiver cost?

We strive to be as transparent as possible about costs. The U.S. CBP has recently increased the waiver application fee from $585 USD to $1,100 USD. The total cost of a waiver application can vary significantly, but in most cases, we are seeing final costs ranging between $2,700 and $3,000 CAD.

  • How long are US Waivers valid for?
